40 Year Recertification requires that buildings in Florida be re-certified for electrical and structural safety every 40 years to confirm in reasonable fashion that the structure under consideration is safe for continued use under the present occupancy. Upon expiration of 40 years, the county or city building authority will send out a “Notice of Required Inspection” that will prompt you of the time for 40 Year building inspection (and every 10 years thereafter).

The 40 Year Recertification of Real Estate Property is a requirement, under Section 8-11 (f) of the County Code, for buildings that have been in existence for more than 40 years and every 10 years thereafter, to be inspected for the purpose of determining the general structural and electrical safety condition.

Property owners have 90 days or a notice of code violations might be issued without further notice and property can be reported as unsafe structures for initiation of condemnation process. You might be liable for a maximum fine of $10,510 and all enforcement costs. Local government Code compliance enforcement unit might vacate and demolish the structure.

The following properties are exempted: Single family homes residences, duplex and minor structures, townhouses, non-residential buildings on farms and other structures buildings with an occupant load of ten (10) or less and 2,000 square feet or less are exempted.
